Standard Terms and Conditions
1. Introduction
Welcome to the CJ van Niekerk Brand Consulting CC website (the "Site"). By accessing and using this Site, you agree to comply with and be bound by the following terms and conditions ("Terms"). If you do not agree with these Terms, please do not use this Site.
2. Definitions
"Site" refers to the CJ van Niekerk Brand Consulting CC website located at cjvnconsulting.com

"Consultant" or "We" or "Us" refers to CJ van Niekerk Brand Consulting CC, a close corporation with limited liability duly incorporated in terms of the laws of Namibia, with registration number CC/2024/08140.
"Services" means the brand consulting services offered by the Consultant as described on the Site.
3. Use of the Site
3.1. The Site is intended for informational purposes and to facilitate communication between Users and the Consultant.
3.2. You agree to use the Site only for lawful purposes and in a manner that does not infringe on the rights of others or restrict their use of the Site.
3.3. You are responsible for ensuring the accuracy of any information you provide through the Site.
4. Services and Quotations
4.1. The Services offered by the Consultant are described on the Site.
4.2. Any quotations provided on the Site are for informational purposes only and do not constitute a binding offer.
4.3. A formal agreement for Services will be entered into separately between the Client and CJ van Niekerk Brand Consulting CC.
4.4. The Consultant shall send an invoice to the Client for such part of the Service Fee monthly in advance for the work to be completed within that month, which invoice shall be payable within 3 (three) calendar days of receipt thereof. The Client agrees that the Consultant will not be expected to commence work unless the invoice for that month has been paid in full.
5. Intellectual Property
5.1. The content on this Site, including text, graphics, logos, and images, is the intellectual property of the Consultant and is protected by copyright laws.
5.2. You may not reproduce, distribute, or modify any content from this Site without the Consultant's prior written consent.
5.3. Copyright for any works created by the Consultant as part of provided services remains the property of the consultant, even after full payment.
5.4. The consultant is not liable for copyright issues that arise from 3rd party service providers.
6. Limitation of Liability
6.1. The Consultant shall not be liable for any direct, indirect, incidental, or consequential damages arising from your use of the Site or the Services.
6.2. The Consultant makes no warranties or representations about the accuracy or completeness of the content on the Site.
6.3. The consultant is not liable for work produced by third party service providers.
7. Governing Law
7.1. These Terms shall be governed by and construed in accordance with the laws of the Republic of Namibia.
7.2. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Namibia.
8. Changes to These Terms
8.1. The Consultant reserves the right to modify these Terms at any time.
8.2. Any changes will be posted on this page, and your continued use of the Site constitutes acceptance of the revised Terms.

10. Whole Agreement
10.1 This agreement constitutes the whole agreement between the two parties.
11. Variation to be in Writing
11.1 No addition to or variation, deletion, or agreed cancellation of all or any clauses or provisions of this agreement will be of any force or effect unless in writing and signed by both parties.
12. Breach
12.1 Should any party commit a breach of any provision of this agreement and fail to remedy such breach within 14 calendar days of receiving written notice, the other party can cancel the agreement or claim immediate specific performance, and in each case with or without claiming damages.
